TURRIL ESTATES
NOTICE OF RESTRICTIONS WHEREAS, J & R Investments of Le Sueur, LLC, hereinafter referred to as "Developer" has caused to be platted a subdivision known as "Turril Estates" in the City of Le Sueur, County of Le Sueur, and State of Minnesota, dividing the same into lots, blocks, streets and outlots, and WHEREAS, Developer intends to convey certain lots more specifically described on Exhibit "A" subject to the restrictions set forth in this document for the purpose of allowing such restrictions to inure to the benefit of each and all purchasers and owners of such lots and their heirs, personal representatives, administrators, successors and assigns. NOW THEREFORE, the Developer does hereby give notice to all purchasers and their heirs, personal representatives, administrators, successors and assigns of such lots described in Exhibit "A" and to whomever it may concern, that each and every lot described in Exhibit "A" shall be subject to the following restrictions: PART A. RESIDENTIAL AREA COVENANTS. A-1. LAND USE AND BUILDING TYPE. The lots described on Exhibit "A" shall be used only for residential purposes. Each owner of a residential home shall have at least a double car garage that is attached prior to the time of temporary or permanent occupation of such home. No building shall be erected, altered, placed, or permitted to remain on any such lot other than residential homes, private garages and their appurtenances not to exceed two and one-half stories in height. All buildings shall be of new construction and built on-site. Only floor joists and roof trusses may be assembled off-site and brought to the property for final inspection. Manufactured homes, as defined by M.S.A. 327.31, Subdivision 6 and Wall Panel Homes or stud wall sections shall not be permitted on any such lot. Any accessory building must have a shingled roof and be sided with the same siding material and be of the same color as the primary structure and must be approved by the architectural control committee as to location and design. No pole buildings will be allowed on any of the lots described on Exhibit "A". A-2. ARCHITECTURAL CONTROL. No building shall be erected, placed or altered on any lot described on Exhibit "A" until the construction plans and specifications and a plan showing the location of the structure have been approved by the architectural control committee as to quality of workmanship and materials, external design, location with respect to topography, finish grade elevation, and such other standards and specifications as the architectural control committee may, from time to time, adopt. The decision of the committee shall be final. A-3. DWELLING SIZE. The ground floor area of the main structure, exclusive of breezeways, one-story open porches and garages, shall be not less that 1,100 square feet for a one-story dwelling, and not less than 1,100 square feet for a dwelling of more than one-story. A-4. BUILDING LOCATION. The front foundation of every residence and attached garage shall be not closer than 30 feet nor further than 45 feet from the street lot line. The foundation of such residence and attached garage shall not be closer than 10% of the building lot width from the side property line, unless the building lot width is less than 100 feet, and in such instance shall not be closer than 5 feet to the side property line. The foundation of such residence and attached garage shall not be closer than 20 feet from the side property line along any street adjoining the side property line. No garage which is not directly attached to the residence shall be located closer to the front lot line than 10 feet to the rear of the nearest rear corner of such residence, nor closer than 30 feet from the rear lot line, nor closer than 8 feet from any side property line, nor closer than 20 feet from the side property line along any street adjoining the side property line. Every residence which is erected or placed on any of said building lots or plots shall face the street which passes along and in front of the front line of said building lots or plots. The Committee mentioned in Paragraph B-1 hereof, in addition to all other powers, rights and authority granted to it in said paragraph, shall have full power, rights and authority to prescribe additional restrictions for the location of residences, garages, and other buildings to be built on the aforesaid lots in this paragraph mentioned and described. The decision of the Committee shall be final. A-5. LOT AREA AND WIDTH. No dwelling shall be erected on or placed on any such lot having an area of less than 10,000 square feet. A-6. EASEMENTS. Easements for installation and maintenance of utilities and drainage facilities are reserved as shown on the recorded plat. A-7. NUISANCES. No noxious or offensive activity shall be carried on upon any lot described on Exhibit "A", nor shall anything be done thereon which may be or may become any annoyance or nuisance to the neighborhood. All structures on any lot must be maintained in a neat condition appropriate to the character of the neighborhood. No resident of any dwelling shall use any lot or garage to repair motor vehicles, boats or recreational vehicles unless said vehicle is their personal vehicle and repairs are performed in the garage or outbuilding and screened from view. A-8. TEMPORARY STRUCTURES. No structure of a temporary or permanent character, trailer, mobile home, basement, tent, shack, garage, barn or other out building shall be used on any such lot at any time as a residence either temporarily or permanently. A-9. SIGNS. No signs of any kind, other than subdivision sale signs, shall be displayed to the public view on any such lot, except one sign of not more than five square feet advertising the property for sale or rent, or sign used by a builder to advertise the property during the construction and sales period. A-10. LIVESTOCK AND POULTRY. No animals, livestock, or poultry of any kind shall be raised, bred, or kept on any such lot, except that dogs, cats, or other household pets may be kept, provided that they are not kept, bred or maintained for any commercial purpose. A-11. GARBAGE AND REFUSE DISPOSAL. No lot described on Exhibit "A" shall be used or maintained as a dumping ground for rubbish. Trash, garbage or other waste shall not be kept except in sanitary containers. All equipment used for storage or disposal of such materials shall be kept in a clean and sanitary condition. A-12. INDIVIDUAL WATER SUPPLY SYSTEM. No individual water supply system shall be permitted on any such lot. A-13. SEWAGE DISPOSAL. No individual sewage disposal system shall be permitted on any such lot. A-14. STORAGE OF FUEL. All storage of fuel shall comply with regulations promulgated by the State of Minnesota, the City of Le Sueur, or any other public body having jurisdiction of fuel storage issues. A-15. WALLS OR OTHER CONSTRUCTION. No walls, steps, or other construction, except sidewalks, shall be placed or maintained forward of the front lot line, nor encroach on the boulevard. A-16. REMOVAL OF SOD, SOIL, ETC. No sod, soil, sand, or gravel shall be sold or removed from the lots described on Exhibit "A", except for the purpose of excavating for the construction or alteration of a residence or an appurtenance of such residence or for the proper grading of the lot. A-17. FENCES. No front yard fence shall be built on any such lot to a greater height than 3 feet. All other fences shall not exceed 6 feet in height nor shall there be, constructed on any such lot, any fence other than open spindle, picket, metal or slat which is at least 30% open for light and air. A-18. SIGHT DISTANCE AT INTERSECTIONS. On any corner at a street intersection which has some form of traffic control there shall be no obstruction to traffic visibility within the clear site triangle which is formed by the intersecting streets at a straight line joining the two center lines at points 35 feet in distance from their point of intersection as measured along such center lines. On any corner lot described on Exhibit "A", which does not have any form of traffic control, there shall be no obstruction to the traffic visibility within the clear site triangle which is formed by the intersection of the center line of the two intersecting streets at a straight line joining the two center lines at points 88 feet in distance from their point of intersection as measured along such center lines. A-19. BUSINESS RESTRICTIONS. No person shall conduct any business or profession from any lots described on Exhibit "A", provided, however, that home occupation businesses may be permitted by the Architectural Control Committee, if such person obtains a Home Occupation Permit from the City of Le Sueur. A-20. CONSTRUCTION TIME TABLE. Construction shall be commence within three years from the purchase date of the lot. Once excavation has commenced, construction of the dwelling including decks and patios of the home must be fully completed within one year. Landscaping must be completed within 180 days from the date the Certificate of Occupancy is issued. Once excavation for an outbuilding has begun, it must be fully completed within six (6) months. A-21. STORAGE AND PARKING. There shall be no long term (two weeks) outside storage or parking of motor vehicles, trailers, campers, boats, snowmobiles, recreational vehicles, equipment and refuse. Firewood shall be stored in screened areas out of public view. No commercial trucks and commercial trailers shall be parked on the street overnight. Refuse shall be kept in sanitary containers in a neat and clean condition and be collected regularly. A-22. RENTALS. There shall be no rentals of any structure on any lot described on Exhibit "A" without the express written consent of the architectural control committee. PART B. ARCHITECTURAL CONTROL COMMITTEE B-1. MEMBERSHIP. The Architectural Control Committee is the J & R Investment of Le Sueur, LLC who shall also have the right in its discretion to select other persons to serve on the Committee and may delegate authority to other persons to act on its behalf as the Architectural Control Committee. B-2. PROCEDURE. The Committee�s approval or disapproval, as required in these covenants, shall be in writing. A copy of such approval or disapproval shall be sent to the applicant within 60 days after written plans and specifications have been submitted to it. Provided, however, in the event the Committee obtains an injunction or restraining order within such 60 day period, such 60 day period shall be tolled until such injunction or restraining order is lifted after which time the remaining portion of such 60 day period shall be allowed to continue until expiration. If the Committee fails to approve or disapprove the applicant�s request within such 60 day period (as it may be extended in the event of an injunction or restraining order being filed), approval will not be required and the related covenants shall be deemed to have been fully complied with. B-3. EXCEPTIONS. It is understood that special unforeseen conditions may require exceptions in certain cases, which may be permitted with the written consent of the Architectural Control Committee, provided the spirit and intent of these restrictions are adhered to. PART C. GENERAL PROVISIONS C-1. TERM. These covenants are to run with the land and shall be binding on all parties and all persons claiming under them for a period of 30 years from the date these covenants are recorded, after which time said covenants shall be automatically extended for successive periods of 10 years unless an instrument signed by a majority of the then owners of the lots has been recorded agreeing to change said covenants in whole or in part. C-2. ENFORCEMENT. (a) Enforcement shall be by proceedings at law or in equity against any person or persons violating or attempting to violate any covenants of this Notice of Restrictions. (b) If any party shall violate or attempt to violate any of the covenants of this Notice of Restrictions prior to their expiration, it shall be lawful for any party or parties of interest in any lot described on Exhibit "A" to institute and prosecute proceedings at law or in equity against the parties violating or attempting to violate these covenants. C-3. SEVERABILITY. Invalidation of any one of these covenants by judgment or court order shall in no way affect any of the other provisions which shall remain in full force and effect. C-4. AMENDMENT. These Restrictive Covenants may be amended by an instrument signed by the Owners and first mortgagees of at least 66% of the lots in the Subdivision and each amendment must be recorded with the County Recorder�s Office or Registrar of Titles Office, Le Sueur County, Minnesota to be effective. IN WITNESS WHEREOF, the said Developers have caused these presents to be executed this _____ day of _____________, 2004, and these Restrictions to be filed in the Office of the County Recorder, Le Sueur County, Minnesota.
